Chief Justice of India (CJI)
After the establishment of the Supreme Court of India in 1950, it has seen the 48 CJI. The President appoints the Chief Justice of India and Judges of the Supreme Court under article 124 (2) of the Indian Constitution.
Appointment of Chief Justice of India (CJI)
- The President of India appoints the CJI after the consultation of the judges of the supreme court and the High Court as it seems necessary.
- The Union Minister of Law and Justice seeks the ongoing CJI recommendation for the appointment of the next Chief Justice of India.
- As per the tradition, the senior-most judge of the Supreme Court will be appointed as the CJI.
- If there is any doubt about the senior-most judge of the Supreme Court for the appointment as the CJI. The Constitution of India under Article 124 (2) advised for consultation from the other Judges.
- After getting the CJI recommendation the Union Minister of Law and Justice put it to the Prime Minister and the Prime Minister will advise the President of India for the appointment of CJI.
Qualification for the Chief Justice of India
The Constitution of India does not provide any qualification for the CJI, the qualification of CJI would be the same as for Judges of the Supreme Court. The qualification for the appointment as the Judge of Supreme Court is given below:
- He should be an Indian citizen.
- The appointee should be a High Court/s Judge for 5 years. Or
- An advocate of High Court/s for 10 years. Or
- In the opinion of the President, he should be a distinguished jurist.
